In the Matter of Procedures for the Access and Management of Non-Public Documents in Criminal Cases
STANDING ORDER 25-03
(Superseding Standing Order 25-02)
WHEREAS a recent escalation in cyberattacks on the CM/EOF systems of federal courts requires the implementation of new procedures for the storage and management of sealed, restricted, and ex parte documents hereinafter referred to as non-public documents;
IT IS ORDERED that, effective as of the date of this order and until such time as the Court orders otherwise,
1. Electronic Access to Non-Public Documents. Non-public document filing shall resume in criminal cases, magistrate cases, and miscellaneous cases in CM/ECF under existing procedures but will no longer be accessible or viewable by electronic means.
2. Service of Non-Public Documents Filed in CM/ECF. Because non-public documents filed in CM/ECF are no longer accessible or viewable electronically, where service is required, it cannot be accomplished through CM/ECF. Parties must serve non-public documents by other appropriate means as provided by the Federal Rules of Procedure.
3. This Order supersedes Standing Order 25-02 and all inconsistent prior court orders, CM/ECF procedure manuals, and local rules.
